At CyberGlint, data privacy and security are paramount to us. We understand your data is crucial for your business, so we handle it with great care and take its protection seriously.
These terms and conditions ('T&Cs') set forth below and as confirmed at least in text form by CyberGlint LLC and, concluded data processing agreement ('DPA') form the entire contract agreed between CyberGlint LLC ('CyberGlint') and the respective client ('Client') (the 'Agreement'). Please contact us for a signed copy of our DPA.
1.1 By accessing and using CyberGlint's services, you agree to be bound by these Terms of Service ("Terms").
1.2 If you do not agree to these Terms, please do not use the service. Please do however get in touch with us so we can try to help.
2.1 CyberGlint provides lead generation services that help businesses find potential customers and advertise to them through integrated social networks.
2.2 Our services include lead discovery, qualification, and delivery of interested leads to clients.
2.3 Clients pay per qualified lead that responds to campaigns, with pricing based on the advertising channel used.
3.1 Clients are responsible for providing accurate information about their business and target audience.
3.2 Clients must comply with all applicable laws and regulations regarding marketing, advertising, and data privacy.
3.3 Clients must not use our services for any illegal, harmful, or unethical purposes.
3.4 Clients are responsible for the proper handling and processing of leads provided by CyberGlint in accordance with applicable data protection laws.
4.1 Pricing is based on the advertising channel used to generate leads, ranging from $40 to $60 per qualified lead.
4.2 Invoices will be issued on a monthly basis or at the end of a campaign, whichever comes first.
4.3 Payment is due within 30 days of invoice issuance.
4.4 Late payments may result in suspension of services and late payment fees.
5.1 CyberGlint will qualify leads based on criteria agreed upon with the Client.
5.2 Only leads that meet the qualification criteria and have expressed interest will be charged to the Client.
5.3 Clients have 7 days to dispute the quality of a lead, after which the lead will be deemed accepted.
6.1 Clients may be required to grant CyberGlint access to their social media accounts for campaign purposes.
6.2 CyberGlint will use such access only for the purposes of providing the agreed-upon services.
6.3 Clients remain responsible for compliance with the terms of service of the respective social media platforms.
7.1 Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the business relationship.
7.2 CyberGlint will not disclose Client information to third parties except as necessary to provide the services or as required by law.
8.1 Each party retains all rights to their respective intellectual property.
8.2 Clients grant CyberGlint a limited license to use their branding materials for the purpose of creating and running campaigns.
8.3 CyberGlint retains all rights to its proprietary lead generation technology and methodologies.
9.1 CyberGlint's liability is limited to the amount paid by the Client for the services in the 12 months preceding the claim.
9.2 CyberGlint is not liable for any indirect, consequential, or incidental damages.
9.3 CyberGlint does not guarantee specific results from the leads provided, as conversion depends on many factors outside our control.
10.1 The Agreement begins when the Client engages CyberGlint's services and continues until terminated by either party.
10.2 Either party may terminate the Agreement with 30 days' written notice.
10.3 CyberGlint may terminate the Agreement immediately if the Client breaches these Terms.
10.4 Upon termination, the Client remains responsible for payment of any outstanding invoices.
11.1 These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.
11.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Mexico.
12.1 CyberGlint reserves the right to modify these Terms at any time.
12.2 Clients will be notified of any material changes to these Terms.
12.3 Continued use of CyberGlint's services after such modifications constitutes acceptance of the updated Terms.
